USCIS has issued new policy guidance concerning adjustment of status (AOS) to permanent residence, reaffirming the agency’s discretionary authority in adjudicating adjustment applications and placing renewed emphasis on consular immigrant visa processing abroad. While adjustment of status remains an available pathway to permanent residence, the guidance will likely increase scrutiny in certain cases, require new evidentiary showings related to discretionary approval, and influence workforce mobility planning and employee travel considerations.
