The Department of Homeland Security (DHS) has published a proposed rule that appears to end the government’s deference to prior petition approvals and would replace “Duration of Status” with fixed periods of admission for F-1 students, J-1 exchange visitors, I visa holders and their dependents. If finalized, this rule would significantly change how compliance is managed for schools, employers and international employees. Employers, universities and others have the opportunity to shape what the final rule may be by commenting on the proposed rule through the legally-mandated “notice and comment” process.
